Terms and conditions.
1. Parties.
1.1 This agreement outlines the terms and conditions Andy Brown Photography (The Photographer) provides his services by. By hiring our photography services, it shows that you (The Client) agree to the terms and conditions below.
2. Copyright and usage.
2.1 Copyright for all images captured during coverage is assigned to The Photographer.
2.2 The Client is licensed to share and print the images you receive as part of their own business marketing.
2.3 With permission from The Client, The Photographer reserves the right to use these images within his portfolio and/or commercial and promotional use.
2.4 Images cannot be published online after being altered or having filters applied to in any way that misleads from The Photographer's original style.
2.5 Should an opportunity arise for your images to used for a third party (advertising for other businesses, etc), permission must first be obtained from The Photographer.
3. Coverage and approach.
3.1 The Photographer will strive to cover all images and ideas previously discussed with The Client. However, there is no guarantee that all images and ideas will be covered.
3.2 The Photographer’s primary approach is journalistic/documentary.
3.3 The Photographer is not limited to any creative/stylistic restrictions.
4. Payment.
4.1 A non-refundable 33% booking fee is required to reserve the session date. This can be made as a bank deposit or for clients outside of New Zealand, payment can be made via PayPal or credit card.
4.2 The booking fee is to be paid within 7 days of receipt of your invoice.
4.3 The final balance is to be paid within 7 days after receiving your final balance invoice, this is sent out during the week leading up to your shoot.
5. Liability.
5.1 In the event of The Client cancelling the session or changing to a date that makes The Photographer unavailable, the booking fee (stated above in section 4.1) will be revoked and is non-refundable. In the case where The Photographer has accommodation, travel (land, sea, air) and hirage expenses incured, The Client is liable to pay for these in full. It is at the Photographer's discretion whether a full or partial refund can be given.
5.2 If The Photographer is unable to cover any part of the session due to illness, injury, or any other reason beyond his control, the Clients will be entitled to a full refund of any moneys paid.
5.3 In the event of section 5.2, The Photographer will notify The Client as early as possible and liaise with a network of professional photographers to try and provide a replacement, or schedule in an alternative session date.
5.4 If The Client agrees to hire a replacement photographer, Andy Brown has no further obligations under this agreement, and The Clients will enter under a new agreement with a new photographer.
5.5 While the utmost care and professionalism is taken with The Client’s digital files/images, The Photographer’s liability is limited to providing a full refund in the unlikely event of lost or damaged files due to technical failure or any other reason.
5.6 The locations during the day and travel to and from these locations sometimes present exposed/hazardous areas. Although guidance and expertise are provided from The Photographer, safety of The Client and other guests is at their own risk.
5.7 In the event of a helicopter flight, The Photographer reserves the right not fly in Robinson machines.
5.8 In the event of the photo shoot unable to proceed due to circumstances out of both The Photographer and The Client's control (i.e, lockdown, travel restrictions), The Photographer will work with The Client to reschedule a new date. The booking fee will be transferred to the new date and is non-refundable.
6. File delivery.
6.1 The Client’s finished selection of images chosen by The Photographer will be delivered as high resolution .jpg files suitable for printing up to large sizes.
6.2 Due to the varied nature and length and character of photo sessions, The Photographer does not guarantee any certain quantity of images. As a guide, The Client will receive approximately 50-75 photos per hour of shoot time.
6.3 Images will be edited for correct density, exposure, contrast and colour, with a selection being converted and edited in black and white at the Photographer’s discretion. Additional colour conversions / editing may attract an additional editing fee.
6.4 The Photographer’s editing style is documentary (as mentioned in 3.2), meaning photo retouching is very light and applied only where required for key photos. This is to ensure photos reflect real people and events of the day for years to come. Heavy retouching at the Client’s request is at The Photographer’s discretion and may attract an additional editing fee.
6.5 Delivery time is dependent on The Photographer’s current workload and commitments. Usually a 6 week timeframe is given from the session date, however this is subject to change. The Client will be notified if this occurs.
6.6 Final images are delivered in .jpg format
